Rental Agreement, Assumption of Risk & Indemnification Agreement

PLEASE READ CAREFULLY BEFORE SIGNING. This is a legally binding agreement that affects your legal rights.

1. Definitions

• “Activity” means renting and/or using any equipment provided by Blue Dream Water Sports, including paddle boards, jet skis, tritoon boats, guided excursions, and captained cruises.

• “Company” refers to Blue Dream Water Sports, its owners, employees, contractors, and affiliates.

• “Participant” means any individual using or participating in the Activity.

• “Customer” means the person renting equipment and/or signing this agreement.

• “Equipment” includes all rental gear such as paddle boards, personal watercraft (jet skis), boats, and related accessories.

• “Protected Parties” includes the Company and all associated individuals or entities.

2. Binding Agreement

This is a binding contract. In consideration of being allowed to rent equipment and participate in Activities, the Customer and Participant agree to all terms outlined in this agreement.

3. Acknowledgment of Risk

I understand that participation in water sports activities is inherently dangerous and may result in serious injury or death.

Risks include, but are not limited to:

• Drowning or water-related incidents

• Collisions with boats, docks, or other objects

• Equipment failure or malfunction

• Changing water or weather conditions

• Slips, falls, or loss of control

• Actions of other participants or third parties

I acknowledge that these risks may arise from known or unknown causes.

4. Assumption of Risk

I voluntarily assume all risks associated with participation in the Activity, whether known or unknown, and accept full responsibility for any injury, damage, or loss that may occur.

5. Customer Responsibility for Equipment

The Customer agrees that:

• Equipment is received in good working condition

• Equipment will be used safely and responsibly

• Equipment will be returned in the same condition (normal wear excepted)

Customer is financially responsible for:

• Damage, loss, or theft of equipment

• Costs associated with misuse or negligence

• Retrieval costs if equipment is abandoned or improperly returned

6. Participant Fitness & Ability

I confirm that:

• I am physically capable of participating

• I have no medical conditions that would make participation unsafe

• I accept responsibility for my own safety and actions

7. Rules, Laws & Safe Operation

I agree to:

• Follow all Georgia boating laws and DNR regulations

• Follow all safety instructions provided by the Company

• Wear life jackets as required

• Operate equipment responsibly

I understand that:

• No operation is allowed under the influence of drugs or alcohol

• Unsafe behavior may result in termination of rental without refund

8. Equipment Damage or Breakdown

I understand that equipment may malfunction. If equipment becomes inoperable:

• The Company will make reasonable efforts to repair or replace it

• No guarantees of replacement or refund are provided

9. Boat Use & Location Restrictions

Equipment must remain within designated operating areas.

If equipment is:

• Removed from approved areas

• Abandoned or stranded

The Customer is responsible for all recovery costs.

10. Captained Boat Experiences

For boat cruises with a captain:

• The captain has full authority over safety and operations

• All passengers must follow instructions

• Unsafe behavior may result in early termination without refund

11. Indemnification

I agree to indemnify and hold harmless Blue Dreams Water Sports from any claims, damages, losses, or expenses arising from:

• My participation

• My actions or negligence

• Damage to equipment or injury to others

This obligation survives the completion of the Activity.

12. Payment & Fees

Customer agrees to pay:

• All rental fees

• Any damages or additional charges incurred

• Applicable recovery or cleaning fees

The Company may charge the Customer’s payment method on file for any outstanding balances.

13. Governing Law

This agreement shall be governed by the laws of the State of Georgia. Any disputes shall be handled within Georgia jurisdiction.

14. Acknowledgment & Signature

By signing, I acknowledge that:

• I have read and understand this agreement

• I am voluntarily agreeing to all terms

• I understand I am waiving certain legal rights
